Hadley Select Board wants dog leash, no swimming rules posted on new kiosk

HADLEY — A requirement that dogs be on leashes and a prohibition on people swimming in the reservoirs are likely to be among rules the Select Board will ask to have placed on a new kiosk being installed on Bay Road by Kestrel Land Trust.

Board members at Wednesday’s meeting told Town Administrator Carolyn Brennan that they want the kiosk to outline rules and the various stipulations for people using the town-owned land, in part to protect the town from liability, as the site becomes more integrated into a regional trails system.

Last fall, the board agreed to a plan presented by Kestrel to designate a section of trails that pass by the reservoirs as part of the Robert Frost Trail. That designation allows for the completion of an early 1980s vision for the 42-mile hiking trail that honors the poet.

Board member Joyce Chunglo said the kiosk should state that any dogs accompanying hikers be on a leash.

“I don't want dogs running amok there because everybody is looking for somewhere to walk their dogs,” Chunglo said.

Chunglo added that the kiosk should also note that the Bay Road reservoirs remain open only for use by residents, and that swimming is prohibited in those bodies of water.

The combination of those rules being written on the kiosk should protect the town from liability in case an unleashed dog attacks another hiker, or someone drowns in the reservoirs, she said.

“I agree we need to be concerned about the liability,” said board member Randy Izer. Izer said that dogs being on a leash is an appropriate rule, though he said policing the rules will be a continued challenge.

Meantime, the parking area near the trailhead can only be used by Hadley residents who obtain permits at Town Hall.

Jennifer Sanders James, the licensing coordinator for Hadley, said 80 residents have requested permits this year.

Others who park there will find their vehicles removed. “We do tow actively right now,” Sanders James said.

The permitting system was put in place ensure that people using the area are acting appropriately, including, walking, hiking, fishing and picnicking at the site, and removing any trash they bring with them. Prior to that, police dealt with significant issues at the reservoirs, including people skinny-dipping and sunbathing in the nude and leaving trash behind.

Still, the proximity to the Hampshire College campus and other parts of South Amherst means that people can park nearby and walk to the site.
