South Hadley man arraigned on more child porn charges

SOUTH HADLEY — A South Hadley man who was earlier arraigned on 20 charges of possession of child pornography was arraigned Monday on 11 additional charges.

Thomas E. Horton, 38, pleaded not guilty to three counts of possession of child pornography (subsequent offense) and eight counts of dissemination of visual material depicting sexual conduct involving a child.

Last October, Horton was indicted on 20 charges of possession of child pornography and was released on $1,000 bail.

The new charges are part of the same investigation and are alleged to have stemmed from conduct prior to his arrest last fall.

Assistant Northwestern District Attorney Anne Yereniuk argued that Horton’s bail be set at $10,000 for the new charges, noting the mandatory minimum sentences he faces on them. But his attorney, Lucy DeLaCour, argued Horton has complied with the conditions of his bail on the other charges, and that the district attorney had made it known in October that additional indictments would be coming.

“There has been no new offense,” she said.

DeLaCour also said that Horton’s family wouldn’t be able to afford the $10,000 bail, and that $1,000 was significant for them.

Judge Richard Carey decided against imposing additional bail on Horton and released him on his own recognizance, with conditions identical to the ones given for him in October. Horton’s next court date is on June 8.
