Profs seek probe into UMass police handling of Jason Vassell case

AMHERST -- In a letter late Friday to UMass Chancellor Robert Holub, a group of veteran professors calls for the school to examine whether its police force mishandled its February 2008 investigation of student Jason Vassell after a violent on-campus confrontation.

The faculty members are renewing protests, first presented to Holub in the weeks following the arrest of Vassell (below right) after a fight with two visitors at his campus dormitory, that the school failed to safeguard the student's rights.

The strongly worded letter is signed by Ann Ferguson, Louise Antony and Jules Chametzky. Ferguson and Chametzky are emeritus faculty; Antony is a professor of philosophy.

While they praise the resolution of the case late last week in Hampshire Superior Court, the writers say UMass must address what they see as its tarnished role in the matter.
Holub, the writers say, should ask a newly formed Advisory Commission on Race to examine the UMass Police Department's handling of the incident at Vassell's dorm.

"Justice will not be completely restored unless and until the University acknowledges and discharges its responsibilities to create a fair and safe climate for all students," the letter says. "The University must issue a public apology to Jason Vassell, and must take tangible steps toward ensuring that no incident of this kind ever occurs on our campus again."

The letter alleges that the school acted rashly and unfairly in pushing Vassell, who is black, to withdraw from UMass. They say the school pre-judged Vassell's guilt in the case, in which he was charged with two felonies after using a pocketknife to stab two white men who had initiated a fight, while using racial epithets against Vassell.

The authors of the letter were among the 130 faculty members who brought a petition to Holub in the spring of 2008 that raised questions about the UMass response to the incident. At the time, they asked Holub to offer to readmit Vassell. They also asked Holub to state that the school would guarantee all students safety on campus, regardless of their race.

"We find it difficult to believe that a white student in similar circumstances would have been treated in the same way," the letter states.

The writers call on Holub (left) to act now to correct what they see an an imbalance in how the school has treated Vassell."Now that Jason Vassell’s legal case has been resolved and the District Attorney’s office has agreed to drop the charges against him, we ask you to issue a formal apology to Jason Vassell," the letter says.

Unfounded in fact

The professors' assertion that, "We find it difficult to believe that a white student in similar circumstances would have been treated in the same way," is completely unfounded in fact. They have no idea how a white student would have been treated in a similar situation. The facts, which are not in dispute, are that in response to verbal taunts, Mr. Vassel responded by stabbing two men. If the professors are genuine in their claim that "the university should guarantee all students safety on campus," they would remove race from this case entirely and understand that students who respond to verbal disputes using potentially deadly violence have no place on the University campus.

1. Of course Mr. Vassell admitted a few things pursuant to prompt and final settlement. This way he can’t sue you for Malicious Prosecution, silly. I know all about that sort of stuff as someone who has practiced and been a target by a rabid prosecutor when I was Southern NH NAACP Legal Chair. Cases dismissed after my film maker followed every attempt of the State to trip me up. Fact of the matter is, you shot-gunned him with all matter of charges and didn’t even charge one of his two drunken, white attackers with ANYTHING.

2. Given the disparities in criminal backgrounds between Mr. Vassell and his attackers, the severity of discrepancy between the charges sought against Vassell vs. Bosse and Bowes is appalling, and you got caught at it.

3. You have not weighed in on Lieutenant Thrasher’s racist assumptions that Jason Vassell is a drug dealer, when in fact it is much more likely that Messrs Bosse and Bowes have dealt drugs than Mr. Vassell. Have you recommended any discipline for his attitude yet, or will you ever? Go ahead, shock me. Prove me wrong and I'll buy you a beer but we won't go out and smash any windows, eh?

Look, as a former AAG you and I both know we could sit here and throw a ton of legalese back and forth but I find it more compelling to show the video and give it to you short and sweet. And here is what is the shortest and the sweetest:

I believe your actions in prosecutorial discretion constitute a disparate impact against black men. Similar thing as the ridiculous State v. Baran prosecution here, with a lying prosecutor, and Harrington v. Richter down at SCOTUS.

Even if your actions were not racist, they were ridiculous. If you take some sense of pride in that, some kind of some pyrrhic victory suit yourself my friend, but I’m not fooled.

Your situation is no different than that of the Franconia shooting tragedy in which everyone is white and we are waiting on the full feature film adaptation of Casey Sherman's “Bad Blood: Freedom and Death in the White Mountains."

These faculty members should watch the videotape and be ashamed of themselves. The incident occurred and the UMass Police then arrested all those involved, including the guy with the knife who did the stabbing. That would be Mr. Vassell. The District Attorney then charged them. Then the Dean of Students, not the Police, threatened to suspend Mr. Vassell. UMPD did not mishandle this, IMHO. But this case has certainly had its consequences on UMPD. One of its veteran officers has been accused of racism, by people who don't know him, or what he has done to make UMass a safe place for all.

What was mishandled was the decision not to release the video tape of the incident while charges were pending. The tape makes it clear that arresting everyone was the right decision.

Shame on Jules Chametzky, Ann Ferguson and Louise Antony.
