Two men arrested in alleged assault on disabled man
NORTHAMPTON - A pair of men who allegedly beat and robbed a wheelchair-bound resident of Michael's House on State Street late Thursday night were arraigned in Northampton District Court Friday.
Luis Diaz-Torres, 42, of 54 West St., Apt. 4, Northampton, and Rogelio Montalvo-Sedo, 22, of Springfield, each face charges of armed robbery with a knife and causing injury to a disabled person.
Judge W. Michael Goggins ordered that Diaz-Torres be held on $5,000 cash bail, and Montalvo-Sedo on $1,000 cash bail. A probable cause hearing is scheduled for Feb. 10.
The 38-year-old alleged victim told police that he was listening to music at about 10 p.m. Thursday when he heard a loud knock on one of his windows. Police said the victim recognized Diaz-Torres, whom he knew as "Lee," and let him into the building.
The pair decided to go out and get some beer. In the meantime, Montalvo-Sedo had entered the building. When the victim saw Montalvo-Sedo, he told Diaz-Torres he would not "chill" with him because the man had robbed him in the past, according to police.
That's when police said in court documents that the two alleged attackers began yelling to each other, saying "get him" and "kill him." Police said they physically assaulted the victim in the hallway and threw him from his wheelchair. Diaz-Torres also lifted his shirt to reveal what victim believed was a knife, police said.
The pair then stole an antique watch with rubies and diamonds, a stainless steel neck chain, a cellphone and part of a broken necklace, police said.
The victim got the attention of a neighbor by yelling for help and saying that he was robbed. When police arrived, he was on the floor in the hallway and was frantic, police said.
Paramedics arrived a short time later and helped him back into his wheelchair. They treated a small cut on his hand that police said was not consistent with a stab wound. He refused further treatment.
Though he didn't know Montalvo-Sedo's name, the victim was able to show police a photograph on his digital camera from a previous encounter with him. Police were also able to watch the incident on Michael's House surveillance cameras.
Five hours later, a pair of detectives spotted Diaz-Torres and Montalvo-Sedo walking down Fruit Street and arrested them at 3 a.m.
